New York Parental Alienation
Parental alienation is when a parent coerces their innocent child to separate emotionally, mentally, and/or physically from the other parent. A parent may selfishly manipulate or encourage his/her child to act in a negative manner toward the other parent. After a tough divorce, emotionally fragile children can easily be coerced into parental alienation. Over time, negative treatment can destroy the relationship the child and alienated parent once had unless preventative steps are taken. Common signs of parental alienation include:
- Badmouthing a parent
- Not wanting to visit with a parent
- Withdrawing emotionally and physically from a parent
- Withholding affection from a parent
- Verbally threatening a parent
Parents who have been alienated are left devastated and uncertain. Parental alienation is never easy to comprehend or deal with. Many times, alienated parents may feel they deserve to be treated this way by their children, especially after a complicated divorce or separation. This is certainly not the case. In fact, parental alienation is often viewed as a form of psychological child abuse, and it should never be tolerated.
Parental Alienation and Child Custody
Parents who are responsible, attentive, and caring should be allowed to have a nurturing relationship with their child, regardless of a divorce or separation. When a child-parent relationship is damaged by alienation, the child custody arrangement can be re-evaluated by New York courts. A new custody order can be beneficial to the alienated parent and also the child.
If a child is manipulated or brain washed, he/she can be psychologically injured. Alienated parents can put an end to this treatment and behavior by challenging their custody arrangement. New York courts are becoming increasingly aware of parental alienation. In many cases, the courts will look at parental alienation as child abuse and grant a new custody order with the child’s best interests in mind.
